FRESNO (KMJ) — A young boy who was taken from his southeast Fresno home in the early hours of Friday morning, has since been returned safe and well.
The case is now being treated as a custody battle and Fresno Police say without a custody order there’s no way to determine who was legally allowed to have him.
The two year old was left in the care of his grandparents overnight, but when his mother returned home after a night out she found the boy gone.
“She came home, left at 11, came home at 5.30am”, says Fresno Police Lieutenant Joe Gomez. “When she checked in the room she found the two and half year old missing and the window was open, the bedroom window”.
Fresno Police got the call around 5.30am, and both Officers and Detectives immediately responded to the residence on the intersection of 1st Street and Montecito Avenue.
Detectives managed to contact the father and it was determined he’d taken the boy. He agreed to meet with them and hand the child over, who was then taken back to his mother.
The father is not being arrested for taking the child, and Fresno Police Lieutenant Joe Motoyasu says all indications suggest he didn’t break into the home.
“He was cooperative and once we took his statement and corroborated his statement and contacted the other parties and some of the statements were inconsistent”.
“I just want to clarify this right off the bat, he was not arrested for those original charges”.
